Internet of Salisbury, Inc. Terms and Conditions For Salisbury.Net

The following terms and conditions apply to the Internet accounts provided by Internet of Salisbury, Inc.

SERVICE REFUND:
Salisbury.Net and Internet America has a No Refund on pre-paid Internet Services.  As per your contract, you are responsible for keeping up with our Usage Policy and Terms and Conditions.  If any refund is warranted, there will be a $25.00 administrative free due.

BILLING INFORMATION:
1. The customer agrees to pay Internet of Salisbury, Inc.(IOS) for any charges relating to the customer's Internet account or accounts. All new accounts paid by check, cash or Credit card, are subject to a minimum fee of 3 months' usage, unless special offers are available. No refunds . A credit will be assigned to your account for early termination of your prepaid service after the first 3 months initial service period.

2. Sales and use taxes, and all other applicable taxes and levies which are applicable to the provision of Internet services shall be borne by the Customer, regardless of whom the taxes and levies are or were imposed upon.

3. All invoices are due upon receipt. Quarterly payments by check must be received prior to the beginning of the next quarter.

4. IOS reserves the right to suspend access for service to a customer's account for delinquent payments. A reconnection fee of $10.00 will/may apply after payment of any delinquent balance. Access will be terminated by the first day of the first month in which payment is due.

5. Your account is for your personal use. Do not give out your account information to anyone.

6. There will be a $25.00 fee for all returned checks.

GENERAL:
Use of the Internet service supplied by IOS is expressly limited to the customer, the customer's immediate family, and/or the customer's direct employees. Account sharing (2 or more simultaneous dial ups) is not permitted.

The customer is responsible for all software and equipment necessary for the connection to the Internet.

Use of the Internet for unsolicited advertising is prohibited.

The customer agrees to use the Internet service in a manner consistent with any and all applicable laws.

IOS may modify these Terms and Conditions upon notice published online. The customer's use of Internet service after the notice is posted shall constitute Customer's acceptance of such changes to the Terms and Conditions.

The information available on the Internet is the property of its information Providers or other Internet users. The customer shall not redistribute, reproduce, or commercially exploit such information without express written permission of its owner. Information Providers shall have the right to assert and enforce such copyright provisions directly on their own behalf.

Customer submitting information owned by Customer for publication on the Internet grants IOS non-exclusive permission to distribute the information product worldwide. Customer retains all rights he/she may have to such information.

Customer hereby agrees that any material submitted for publication on the Internet through Customer's Account(s) does not violate or infringe upon any copyright, trademark, patent, statutory, common law or proprietary rights of others, or contain anything obscene, objectionable, or libelous.

LIMITATION OF LIABILITY: INTERNET OF SALISBURY, INC. INTERNET SERVICES ARE PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE WITH RESPECT TO THESE SERVICES OR ANY INFORMATION OR SOFTWARE PROVIDED THEREBY.
Neither IOS nor its Information Providers are responsible for any damages arising from Customer's use of the Internet or inability to access or use Internet services. There is no guarantee of message delivery.

IOS is not responsible for Customer's personal files residing on the Internet. Customer is responsible-for independent backup of all such data.

Customer is hereby warned that some sites accessible via IOS Internet access allow posting, retrieval, and/or electronic mailing of materials that may be considered obscene or objectionable. IOS is not responsible for inadvertent or deliberate access to such material and cannot prevent access of such data.

Customer is also warned that some material downloaded from the Internet may contain computer viruses. Customer should follow industry accepted practices to minimize the possibility of transferring computer viruses including the application of virus detecting and/or correcting software. IOS takes precautions to insure that public domain software supplied by IOS to enable the Customer to access the Internet is free from computer viruses. However, IOS cannot guarantee an environment free of computer viruses.

OPERATION:
IOS reserves the right to change its services without notice, including but not limited to access procedures, hours of operation, menu structures, commands, documentation, and services offered as well as contractual changes.

IOS reserves the right to delete Customer's personal files which have not been accessed for more than one month. Customer is responsible for confidentiality of all account numbers and passwords. IOS will suspend access or change access to customer's Account immediately upon notification by customer that a password has been lost, stolen or otherwise compromised.

Customer understands that Internet services may be interrupted for several reasons, including , but not limited to, malfunctions, maintenance, improvement or as required to protect network resources in the event of malfunctions or misuse. Customer understands that there may not be advance notification of any such interruption of service. Scheduled outages will be publicized online.

IOS shall not be liable for any delay in or failure to perform the services caused by circumstances entirely beyond its control such as those occasioned by acts of God or other, or which it could not have reasonably foreseen or any other cause similarly impeding service.

IOS reserves the right in its sole discretion to delete any information entered in Internet computer systems by Customer. IOS and its authorized representatives shall have the right, but shall not be obligated, to edit publicly viewable information.

IOS, at its sole judgment, may immediately suspend Customer's access to the service upon any breach of any of the Terms and Conditions by Customer, including, but not limited to, refusal or failure to pay for services provided or disruptive online behavior.

IOS reserves the right to terminate access to service for any Customer Account which has not been active for six months or longer.

Change of Policy:
Salisbury.Net and Internet America reserves the right to change these policies at any time without notice.  By accessing our system you are agreeing to all of our posted Terms and Conditions.
